Congress Approves CBD Use by Military Service Members

The United States House of Representatives approved an amendment on Monday, July 27, 2020 that allows active military services members to use hemp products including CBD. This measure, which was sponsored by Representative Tulsi Gabbard (Hawaii Democrat), specifies that the “Secretary of Defense may not prohibit, on the basis of a product containing hemp or any ingredient derived from hemp, the possession, use, or consumption of such product by a member of the Armed Forces” as long as the crop meets the federal definition of hemp and that “such possession, use, or consumption is in compliance with applicable Federal, State, and local law.”

The amendment passed with a vote of 336-71 in a package including dozens or amendments unrelated to cannabis to the National Defense Authorization Act (NDAA). The amendment features other measures approved earlier this month allowing military branches to grant waivers for reenlistment for those who had admitted to past cannabis usage or were convicted of a cannabis related misdemeanor offense.

Representative Gabbard, who is a military veteran and 2020 Democratic presidential candidate herself, filed a bill last year aimed at modernizing the hemp industry, and has encouraged federal research into a wide-range of potential applications for hemp crops. This standalone bill, the “Hemp for Victory Act” would allow for studies into everything from hemp food usage to the therapeutic value of hemp and CBD products particularly for veterans suffering from PTSD or other stress disorders.
